Terms and conditions
RESISTANCE MAGNET SIA, reg. no. 40203450743, legal address Saulkrastu nov., Saulkrastu pag., VEF-Biķernieki, Astotā iela 36, LV-2160, hereinafter referred to as the online store, provides the content available on the website and offers goods/services in accordance with the Terms of Use outlined below.
- General Terms
- If a consumer purchases goods/services through the website, such a mutual agreement is considered a Distance Contract and is subject to the laws of the Republic of Latvia regulating distance contracts, including but not limited to the Consumer Rights Protection Law of the Republic of Latvia, the Cabinet of Ministers Regulations “Regulations on Distance Contracts,” and others.
- Making Purchases
- The prices and specifications of products sold in the online store are indicated next to the products.
- To place an order, add the desired products to the shopping cart. Fill in all required fields and select the most suitable delivery method. The total order cost with delivery will then be displayed on the screen. Complete the purchase payment to finalize the order.
- Payment Terms
- The currency used on the website is the euro. Purchases can be paid for using the following payment methods provided by the payment platform makecommerce.lv, Maksekeskus AS:
- Latvian online bank payments: Swedbank, SEB, Citadele, and Luminor
- Estonian online bank payments: Swedbank, SEB, Luminor
- Lithuanian online bank payments: Swedbank, SEB, and Luminor
- Finnish online bank payments: Aktia, Ålandsbanken, Danske, Handelsbanken, Nordea, Oma Säästopankki, Pohjola, POP Pankki, S-Pankki, Säästopankki
- Visa/Mastercard card payments
- NB! When using the online bank payment method, confirm the order and click the “Return to merchant” button.
Personal data required for payment processing is transferred to the licensed payment institution Maksekeskus AS. - The contract enters into force upon successful payment to the online store’s bank account. If for any reason the order cannot be fulfilled, the Buyer will be informed, and the paid amount will be refunded as soon as possible, but no later than 14 days after receiving the notification.
- Delivery Terms
- Products are delivered to the following countries: Estonia, Latvia, Lithuania. Purchased goods are delivered using Omniva or Venipak parcel services or Venipak courier services. All fees and taxes required to receive the shipment at the delivery destination must be covered by the Buyer. Delivery costs are displayed before order confirmation.
- Purchased products are delivered to the Buyer’s specified address within 2-5 business days. In exceptional cases, we have the right to ship the goods within 45 calendar days, informing the customer.
- Right of Withdrawal
- The Buyer has the right to withdraw from the product within 14 calendar days from the moment of receiving the goods. The right of withdrawal does not apply if the Buyer is a legal entity.
- To exercise the 14-day right of withdrawal, the products may only be used for their intended purpose, and the consumer is responsible for maintaining the quality and safety of the product during the withdrawal period. If the goods are improperly used or damaged, treated negligently, or if instructions are not followed, if the original packaging is
- lost, or if the packaging is significantly damaged, the online store has the right to reduce the refundable amount according to the decrease in product value.
- To exercise the right of withdrawal, you must submit the withdrawal form, which can be found here: MICROSOFT FORMS, sending it to the email address arturs@goodcover.eu within 14 days after receiving the goods.
- The Buyer’s obligation is to return the goods to the Seller without delay but no later than 14 days after submitting the withdrawal form to the online store.
- The Seller has the right to withhold the payment until the Buyer has returned the goods or provided proof of returning the goods. If the Buyer has chosen a delivery method other than the cheapest one offered by the online store, the online store is not obliged to compensate for the exceeded shipping costs.
- The online store is not responsible for delays in the fulfillment of obligations or non-fulfillment due to circumstances beyond the reasonable control of the online store.
- The online store reserves the right to refuse to sell goods and request the return of goods from the Buyer if the price indicated in the online store is significantly lower than its market price due to an error.
- Consumer Rights Regarding Non-Compliant Goods
- The online store is responsible for any non-compliance of the sold goods with the contract terms or defects occurring within 6 months from the delivery date to the customer or existing at the time of delivery, unless such an assumption contradicts the nature of the goods or the defect. The Buyer must inform the Seller of the non-compliance immediately, within 2 months after discovering it, i.e., submit a complaint. The Buyer can submit a complaint by contacting the online store by writing to arturs@goodcover.eu.
- The online store is not responsible for defects that occur after the goods have been delivered to the Buyer. If the purchased goods have defects for which the Seller is responsible, the Buyer has the right to demand the repair of the defects or the replacement of the goods with new ones free of charge.
If the goods cannot be repaired or replaced, the Seller will refund the Buyer all payments specified in the Distance Contract. The Seller provides a written response to the consumer’s complaint within 15 days.
- Processing of Buyer’s Personal Data
- The online store processes only the personal data entered by the Buyer when ordering goods, such as name, surname, email, etc.
- The online store transfers personal data to transport service providers to ensure the delivery of goods.
- If you have explicitly agreed to receive our marketing messages, including newsletters, we may contact you from time to time by sending information about our services and the latest offers. For this purpose, we may process your email address, which you provided when signing up for marketing communications. The Buyer has the opportunity to opt out of marketing messages by notifying us by writing to arturs@goodcover.eu.
- Dispute Resolution Procedure
- In matters not specified in these terms and conditions, the Buyer and Seller undertake to comply with the laws of the Republic of Latvia.
- The Parties shall resolve all disputes between the Seller and the Buyer through mutual negotiations or correspondence. If the dispute cannot be resolved through negotiations or correspondence, the Parties will resolve the dispute in the courts of the Republic of Latvia, following the regulations of the Republic of Latvia. Disputes between the Buyer (consumer) and the Seller may be submitted for resolution to the Consumer Rights Protection Centre or the courts of the Republic of Latvia.
- The Buyer also has the right to apply to the European Union dispute resolution institutions.
